Article 1 – Definitions

1.1 In these terms, unless the context indicates otherwise:
NYDJ: Martens Fashion Group B.V., trading as NYDJ.
Customer: a natural person acting for purposes outside their trade, business, craft or profession who enters into an Agreement with NYDJ.
Agreement: a sales agreement concluded between the Customer and NYDJ via the Website.
Website: nydj.eu.
Returns Portal: NYDJ’s online returns portal as indicated on the Website.

Article 2 – Applicability

2.1 These terms apply to every Agreement concluded via the Website.

Article 3 – Offer

3.1 Images, prices and other information provided by NYDJ are subject to change and are non‑binding.
3.2 NYDJ is not bound by obvious printing, typographical or pricing errors on the Website or in e‑mails. In case of such obvious errors, NYDJ may cancel the order free of charge and will inform the Customer promptly.
3.3 Offers are valid while stocks last or during the period stated on the Website.
3.4 The product assortment on the Website may change at any time.

Article 4 – Images and descriptions

4.1 Product images and information (such as size and colour) shown on the Website are for guidance only and may differ slightly from the actual product due to screen settings and production tolerances. This does not affect your statutory rights if the product does not conform to the Agreement.

Article 5 – Conclusion of the Agreement

5.1 An Agreement is concluded once the Customer has completed the order process on the Website and has accepted these terms.
5.2 NYDJ will send an order confirmation by e‑mail containing the order number and a description of the order.
5.3 The Customer warrants that the details provided to NYDJ are correct and complete.

Article 6 – Delivery

6.1 Indicated delivery times are estimates and not strict deadlines. The Customer acknowledges that delivery may be delayed, for example due to the carrier’s default or customs formalities. If delivery is significantly delayed beyond a reasonable time after any binding agreed date, the Customer may cancel the Agreement and receive a refund of all amounts paid for the affected order.
6.2 Any customs duties and/or import taxes are borne by the Customer.
6.3 The Customer must ensure that the delivery location is safely and reasonably accessible.

Article 7 – Prices

7.1 Prices are shown in euros, include VAT, and exclude any customs duties and/or import taxes.
7.2 NYDJ may adjust prices from time to time.
7.3 During a stated offer period, product prices will not be increased, except for changes resulting from VAT adjustments.

Article 8 – Delivery costs

8.1 Product prices exclude delivery costs. Delivery costs are shown to the Customer before the order is confirmed.
8.2 Delivery costs depend on the rates of the carriers used by NYDJ (including, where applicable, PostNL and DPD) and may change.

Article 9 – Right of withdrawal and returns 

9.1 Cooling‑off period. The Customer has the right to withdraw from the Agreement within 30 days without giving any reason. The 30‑day period starts on the day the Customer, or a third party other than the carrier and indicated by the Customer, physically receives the goods (or the last good in the case of multiple items in one order).
9.2 How to withdraw / register a return. To exercise the right of withdrawal, the Customer must inform NYDJ of the decision to withdraw by a clear statement via the Returns Portal as indicated on the Website. If the Returns Portal cannot be used, the Customer may contact NYDJ Customer Service (customercare@nydj.eu) for assistance. A model withdrawal form is available but not obligatory.
9.3 Return method and fee. Returns should be registered and shipped using the method offered in the Returns Portal. The Customer pays a small contribution to the return costs as shown during the return registration. If the Customer chooses another carrier or method not offered by NYDJ, the Customer bears the risk of the return shipment until it is delivered to NYDJ and must provide adequate proof of shipment showing NYDJ’s warehouse address.
9.4 Return period. The Customer must send back the goods no later than 30 days from the day on which the Customer communicates the withdrawal. The deadline is met if the goods are dispatched before the period of 30 days has expired.
9.5 Condition of returned goods. The Customer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Items should be returned unused, unaltered, unwashed and with original tags and packaging where reasonably possible.
9.6 Refunds. NYDJ will reimburse all payments received from the Customer for the returned goods, including the cost of standard delivery (i.e., excluding any supplementary delivery method costs chosen by the Customer), without undue delay and in any event within 14 days from the day on which NYDJ is informed of the withdrawal. NYDJ may withhold the refund until NYDJ has received the goods back or the Customer has supplied evidence of having sent back the goods, whichever is earlier. Refunds are made using the same means of payment used for the original transaction, unless expressly agreed otherwise and provided that no fees arise for the Customer.
9.7 Goods not originating from NYDJ. NYDJ is not responsible for products enclosed in a return shipment that do not originate from NYDJ or are personal belongings.
9.8 Customs and import charges on returns. NYDJ does not reimburse customs charges and/or import duties related to the import/export of NYDJ products by the Customer. Customers may be able to seek repayment from the relevant authority depending on local rules.
9.9 Exchanges. See Article 10.

Article 10 – Exchanges

10.1 The Customer may request an exchange for a different size (if in stock) or for another product of the same price range via the Returns Portal. If the requested item is not in stock, NYDJ will refund the purchase price in accordance with Article 9.6.
10.2 Exchanged items must be returned in accordance with Article 9 and meet the condition requirements in Article 9.5.
10.3 If the Customer uses a return method not recommended by NYDJ, the Customer remains responsible for the return shipment until received by NYDJ in good order.

Article 11 – Payment

11.1 Payments for orders placed via the Website can be made using credit card, PayPal, Klarna, or iDEAL. Availability of payment methods may vary per country. 11.2 NYDJ applies appropriate security measures for secure electronic payments.

Article 12 – Questions, defects and complaints

12.1 Visible defects should be reported within a reasonable time after delivery. A notification made within two (2) months after the Customer discovers a defect is deemed to be within a reasonable time. Failure to report immediately does not automatically exclude NYDJ’s responsibility where the law provides otherwise.
12.2 These terms apply to purchases made on NYDJ’s official Website. Your statutory warranty rights (legal guarantee) apply and remain unaffected by these terms.

12.4 NYDJ will handle complaints within 30 days. If handling within 30 days is not possible, NYDJ will inform the Customer of the delay and the expected timeline.

Article 13 – Liability

13.1 NYDJ is not liable for damage resulting directly or indirectly from events beyond its reasonable control (force majeure), nor for temporary or permanent unavailability of the Website or the inability to place orders.
13.2 Colours displayed on a Customer’s screen may differ from the actual colours of the product. NYDJ is not responsible for such differences, without prejudice to the Customer’s statutory rights in case of non‑conformity.
13.3 NYDJ is not responsible for damage of any kind arising from incorrect and/or incomplete information supplied by the Customer.
13.4 If NYDJ is liable for any damage, NYDJ’s liability is limited to the amount paid by NYDJ’s insurer. If the insurer does not pay or the damage is not covered, NYDJ’s liability is limited to the invoice amount for the relevant order, or the relevant part thereof.
13.5 The limitations in this Article do not apply in case of intent or gross negligence by NYDJ or its subordinates. Nothing in these terms limits or excludes any rights or remedies that cannot be limited or excluded under applicable consumer law.

Article 14 – Force majeure

14.1 In case of circumstances beyond NYDJ’s control, NYDJ is not obliged to compensate any damage suffered by the Customer as a result, unless and insofar as NYDJ has benefitted from such circumstances to an extent it would not have if delivery had taken place as planned.

Article 15 – Confidentiality

15.1 Both parties shall keep confidential all information obtained from the other party in the context of the Agreement which is of a confidential nature or is reasonably understood to be confidential, and shall use such information only for the purpose for which it was provided.

Article 16 – Intellectual property

16.1 The Customer must fully and unconditionally respect all intellectual property rights related to the products delivered by NYDJ.
16.2 The Customer may not copy, forward, distribute, reproduce or publish any information, texts, logos, brands, trade names or images obtained through the Website without NYDJ’s prior written permission.

Article 17 – Security and privacy

17.1 NYDJ takes appropriate technical and organisational measures to protect the Website against the risks of unauthorised access or alteration and the destruction or loss of data entered by the Customer, but cannot guarantee absolute security.
17.2 Processing of personal data is described in NYDJ’s Privacy Notice, available on the Website (see: https://www.nydj.eu/pages/privacy).

Article 18 – Governing law and jurisdiction; language

18.1 The Agreement is governed exclusively by Dutch law.
18.2 Disputes arising from or related to the Agreement may be submitted by the Customer to the competent court in the Customer’s place of residence or to the competent court in the Netherlands.
18.3 These terms may be available in multiple languages. Translations are provided for convenience only. In the event of any discrepancy in interpretation, the Dutch version shall prevail to the extent permitted by law, and in all cases mandatory consumer protection rules of the Customer’s country of residence remain unaffected.

Article 19 – Promotions and adjustments on returns

19.1 Where an order benefits from a promotion (e.g., discount codes, multi‑buy offers such as “buy 2 get 1 free”, threshold discounts, or bundled offers), any return will be reconciled in accordance with the terms of that promotion.
19.2 If returning part of an order causes the conditions of the promotion to no longer be met, NYDJ will recalculate the amounts due for the items the Customer keeps and adjust the refund accordingly. Example: if a multi‑buy discount applied to three items and the Customer returns one item, the discount may be reduced or no longer apply to the two retained items.
19.3 Promotion‑specific conditions will be displayed on the Website at the time of the promotion and prevail over this Article in case of conflict.

Article 20 – Online Dispute Resolution (EU)

20.1 The European Commission provides an Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr. NYDJ’s e‑mail address for this purpose is customercare@nydj.eu. Use of the ODR platform is optional and does not affect your right to bring proceedings before the competent courts as set out in Article 18.
